When a Patient Says No to Being Recorded

A friend told the founder that Indian patients will not allow recording. Some will not, and that is their right. The question is what the doctor does next.

Some patients will not be recorded

Privacy expectations vary enormously between patients, specialties and cities. A psychiatry patient, a couple in an IVF clinic, or an older patient who distrusts phones may say no. A scribe that only works when everyone agrees leaves those notes to be written by hand, usually at the end of the day.

How to ask

Consent works best when it is short, specific and offered with a real choice:

One tap, and nothing is recorded

In Clinic Scribe, "Patient declined" is a button on the recording screen. One tap logs the refusal and records nothing. The clinic board counts declines, so you can see whether the consent conversation itself needs changing.

Dictate the summary instead

After the patient leaves, the doctor can dictate a short summary - in any of the five languages - and the note is drafted from that. The note says plainly that it was dictated by the doctor, not recorded in the consultation, and it goes through the same checks before signing: a dose outside the usual range, a medicine stopped but written as continued.

What the law asks of the clinic

Under the DPDP Act the clinic is the Data Fiduciary and owns consent. Consent must be free, specific and informed, and the patient can withdraw it. A scribe can make the right thing easy - a consent tick before every recording, a decline button, deletion you can show - but it cannot make the decision for the clinic.

Do I need written consent to record a consultation?

The clinic decides how it records consent, ideally with legal advice. The scribe asks the doctor to confirm consent before every recording and logs it.

Is a dictated note less accurate?

It contains only what the doctor says afterwards, so it is shorter, but it goes through the same checks before signing.
